1. Purpose
This Usage Policy ("Policy") establishes the standards, requirements, and best practices for responsible use of Neuraphic, Inc. ("Neuraphic," "we," "us," or "our") products and services, including but not limited to Prion, Claeth, Workers, our APIs, developer tools, and all related platforms (collectively, the "Services").
While our Acceptable Use Policy defines what is prohibited, this Policy goes further: it explains how to use our Services responsibly, what safeguards must be in place for certain applications, and what obligations users have when deploying AI-powered capabilities to their own customers and end users. This Policy applies globally to all users of the Services, regardless of location or jurisdiction.
We recognize that AI technology presents both significant benefits and meaningful risks. This Policy is designed to help users navigate those considerations thoughtfully and to ensure that our technology contributes positively to the individuals and communities it touches.
2. Universal Standards
The following standards apply to all users of Neuraphic Services, regardless of the specific product, plan, or method of access:
Accuracy and honesty. You should not use the Services to knowingly generate or disseminate false, misleading, or deceptive content. Where AI-generated content may be mistaken for human-created content, you are encouraged to label it appropriately. You are responsible for reviewing AI-generated outputs before relying on them for consequential decisions.
Respect for rights. You must use the Services in a manner that respects the intellectual property rights, privacy rights, and dignity of others. You should not use the Services to generate content that infringes on copyrights, trademarks, or other proprietary rights without appropriate authorization or legal basis.
Security responsibility. You are responsible for maintaining the security of your account credentials, API keys, and access tokens. You must not share credentials with unauthorized parties, and you must promptly notify us if you suspect unauthorized access to your account. You are responsible for all activity that occurs under your account.
Compliance with law. You must comply with all applicable laws and regulations in your jurisdiction when using the Services. Where local law imposes requirements more restrictive than this Policy, local law shall prevail. Where this Policy is more restrictive than local law, this Policy shall prevail.
Feedback and improvement. We encourage users to report issues, inaccuracies, harmful outputs, or unexpected behaviors they encounter. Constructive reporting helps us improve our systems and better serve all users.
3. High-Risk Use Requirements
Certain applications of AI technology involve decisions that can significantly affect the lives, rights, or opportunities of individuals. When using Neuraphic Services in any of the following contexts, you must implement a human-in-the-loop process that ensures meaningful human oversight before any consequential decision is made.
Legal contexts. AI outputs may be used to assist with legal research, document review, or case analysis, but a licensed attorney must review and take responsibility for any legal advice, opinions, filings, or recommendations provided to clients or courts. AI-generated legal content must not be presented as the independent work of a licensed professional without such review.
Medical and healthcare contexts. AI outputs may be used to support clinical decision-making, diagnostic processes, triage, or health-related research, but a qualified healthcare professional must review and validate any diagnosis, treatment recommendation, or clinical decision before it is acted upon. AI-generated medical information provided to patients must be clearly identified as AI-assisted and must not substitute for professional medical judgment.
Financial contexts. AI outputs may be used to inform investment analysis, credit assessments, insurance underwriting, or financial planning, but a qualified financial professional must review any advice or recommendation before it is communicated to clients. Automated financial decisions that materially affect individuals must include human review mechanisms and must comply with all applicable financial regulations.
Employment decisions. AI outputs may be used to assist in recruitment, screening, performance evaluation, or workforce planning, but a qualified human decision-maker must review and approve any decision that affects an individual's employment, compensation, advancement, or termination. Candidates and employees must be informed when AI is used in processes that affect them.
4. Disclosure Requirements
Transparency is fundamental to responsible AI use. Users of Neuraphic Services must disclose AI involvement in the following circumstances:
Consumer-facing interactions. When AI-generated content or AI-driven interactions are presented to consumers or the general public in a manner where the involvement of AI is not obvious, you must clearly and conspicuously disclose that AI is being used. This includes chatbots, virtual assistants, automated customer service, and AI-generated written, visual, or audio content.
Professional and regulated contexts. When AI is used to support decisions in legal, medical, financial, educational, or governmental contexts, you must disclose to affected individuals that AI technology was used in the process and provide them with the opportunity to request human review.
Creative and editorial content. When AI-generated or AI-assisted content is published or distributed in contexts where audiences reasonably expect human authorship — including journalism, academic work, and creative media — you must disclose AI involvement in a manner appropriate to the medium and context.
Marketing and advertising. AI-generated endorsements, testimonials, reviews, or promotional content must be clearly identified as such. You may not use AI to create synthetic endorsements that appear to come from real individuals without their explicit consent.
5. Automated Decision-Making Safeguards
When Neuraphic Services are incorporated into systems that make automated decisions affecting individuals, the following safeguards must be implemented:
Impact assessment. Before deploying automated decision-making systems powered by our Services, you should conduct an impact assessment to identify potential risks of bias, discrimination, or unfair treatment. This assessment should be documented and updated periodically.
Contestability. Individuals who are subject to automated decisions that materially affect their rights, opportunities, or access to services must be provided with a meaningful mechanism to contest such decisions and to request human review. You must communicate the availability of this mechanism clearly and accessibly.
Bias monitoring. You should implement ongoing monitoring for bias and disparate impact in automated decision-making systems. Where bias is detected, you must take prompt corrective action, which may include adjusting the system, supplementing it with additional human oversight, or discontinuing the automated process.
Record-keeping. You must maintain records of automated decisions sufficient to enable audit, review, and contestation. These records should include the inputs provided to the AI system, the outputs generated, and the final decision made. Records should be retained for a period consistent with applicable law and the nature of the decisions being made.
6. API Developer Obligations
If you access Neuraphic Services through our APIs or integrate our technology into your own products, platforms, or services, you assume additional obligations:
Downstream policy enforcement. You must implement and enforce usage policies for your own users that are at least as restrictive as this Policy and our Acceptable Use Policy. You are responsible for ensuring that your end users comply with these standards. We may require you to provide evidence of your downstream policies upon request.
Content moderation. You must implement reasonable content moderation and safety measures in your applications to prevent misuse of Neuraphic-powered capabilities. This includes filtering harmful inputs and outputs where appropriate and providing reporting mechanisms for your users.
Rate limiting and abuse prevention. You must implement appropriate rate limiting, authentication, and abuse prevention measures to prevent unauthorized or excessive use of the Services through your applications.
Documentation and transparency. You must maintain clear documentation of how Neuraphic Services are integrated into your products and make this information available to us upon request. If your application presents AI-generated content to end users, you must ensure appropriate disclosure as described in Section 4.
Incident response. You must promptly notify us of any security incidents, data breaches, or significant misuse of the Services that you become aware of through your integration. You should maintain an incident response plan that addresses potential AI-related harms.
7. Industry-Specific Requirements
Healthcare. Use of the Services in healthcare settings must comply with all applicable healthcare privacy regulations, including but not limited to the Health Insurance Portability and Accountability Act (HIPAA) in the United States and equivalent regulations in other jurisdictions. Protected health information (PHI) must not be submitted to the Services unless a Business Associate Agreement (BAA) or equivalent data processing agreement is in place. Clinical decision support systems built on our Services must be validated in accordance with applicable medical device regulations.
Financial services. Use of the Services in financial contexts must comply with all applicable financial regulations, including consumer protection laws, anti-money laundering requirements, and fair lending obligations. Model risk management frameworks should be applied to AI systems that inform financial decisions. Algorithmic trading systems built on our Services must comply with applicable market regulations and must implement appropriate risk controls.
Government and public sector. Government use of the Services must comply with all applicable procurement regulations, data sovereignty requirements, and civil rights protections. AI systems used in government decision-making must meet the transparency, accountability, and fairness standards required by applicable law and policy. Government users must ensure that the use of AI does not result in the denial of due process or equal protection under the law.
Education. Use of the Services in educational settings must comply with applicable student privacy laws, including the Family Educational Rights and Privacy Act (FERPA) in the United States and equivalent protections in other jurisdictions. AI tools used in grading, assessment, or academic evaluation must incorporate appropriate human oversight, and students must be informed when AI is used in processes that affect their academic standing.
8. Age-Appropriate Use
Neuraphic Services are intended for users who are at least 18 years of age, or the age of majority in their jurisdiction, whichever is greater. Users under the age of 18 may not use the Services directly.
If you develop applications using our APIs that may be accessed by users under 18, you are responsible for implementing appropriate protections, including age verification, age-appropriate content filtering, and parental consent mechanisms as required by applicable law, including but not limited to the Children's Online Privacy Protection Act (COPPA) in the United States, the Age Appropriate Design Code in the United Kingdom, and equivalent regulations in other jurisdictions.
You may not use the Services to collect personal information from children under 13 years of age (or the applicable minimum age in your jurisdiction) without verifiable parental consent. You may not use the Services to generate content that is harmful to minors or that is designed to manipulate, exploit, or take advantage of minors.
9. Content Attribution
When using Neuraphic Services to generate content, you should be aware of the following principles regarding attribution and ownership:
AI-generated outputs should not be falsely attributed to human authors. Where content is substantially generated by AI, this fact should be disclosed in a manner appropriate to the context. In academic and research contexts, the use of AI assistance must be disclosed in accordance with the applicable standards of the institution, publisher, or professional body.
You are responsible for ensuring that your use of AI-generated content does not infringe on the intellectual property rights of others. You should review AI-generated outputs for potential similarities to existing copyrighted works before publishing or distributing them in contexts where such infringement could cause harm.
Neuraphic does not claim ownership of the outputs generated through your use of the Services, subject to the terms of your service agreement. However, you acknowledge that similar or identical outputs may be generated for other users and that AI-generated content may not be eligible for intellectual property protection in all jurisdictions.
10. Enforcement and Consequences
We monitor use of the Services for compliance with this Policy through a combination of automated systems and human review. We reserve the right to investigate suspected violations and to take appropriate enforcement action.
Enforcement actions may range from educational outreach and warnings for minor or inadvertent violations to suspension or termination of access for serious, repeated, or willful violations. The specific action taken will depend on the nature, severity, and context of the violation, as well as the user's history of compliance.
We may require users to demonstrate compliance with specific provisions of this Policy as a condition of continued access, particularly for high-risk or high-volume use cases. We may also impose additional conditions or restrictions on use where we determine that additional safeguards are warranted.
